REALM Group Australia Pty Ltd

These Terms & Conditions govern the use of all websites, platforms, auctions, listings, services and systems operated by REALM Group Australia Pty Ltd and its affiliated entities, including REALM Group Global (“REALM,” “we,” “our,” or “us”).

By accessing or using our services, you agree to be bound by these Terms.

1. About REALM Services

REALM provides an online marketplace and agency services for:

Agricultural machinery and equipment
Livestock
Rural property
Produce and agricultural goods
Auctions and negotiated sales
Marketing and finance facilitation services

REALM acts primarily as an agent or platform provider connecting vendors and purchasers, unless expressly stated otherwise.

2. Definitions

Vendor — The seller of an item or property listed on REALM
Purchaser / Bidder — A person bidding on or purchasing a listing
Lot / Listing — Any item offered for sale or auction
Auction — A sale where the highest bid meeting the reserve is accepted
Platform — REALM websites, systems and affiliated sales channels
Services — All services provided by REALM

3. Acceptance of Terms

By using REALM services, you confirm that you:

Have read and understood these Terms
Are legally capable of entering into a binding contract
Will comply with applicable laws
Accept that additional service-specific terms may apply

4. Registration and Accounts

To participate in auctions or certain services, you must register.

You agree to:

Provide accurate and current information
Maintain confidentiality of login details
Be responsible for all activity on your account
Notify us of unauthorised use

REALM may refuse, suspend or terminate accounts at its discretion. Identity verification checks may be conducted.

5. Bidding and Purchases

When you place a bid:

You are making a legally binding offer to purchase
If you are the winning bidder, you must complete the transaction
You must pay all applicable fees, charges and taxes

Failure to complete a purchase may result in: Account suspension, financial penalties, recovery of losses, or legal action.

6. Vendor Responsibilities

Vendors warrant that:

They have legal authority to sell the item
Listings are accurate and not misleading
Items are not stolen, encumbered, or unlawful to sell
All material defects are disclosed

Vendors are responsible for any loss arising from misrepresentation.

7. REALM’s Role as Agent

REALM generally acts as an agent or intermediary. Unless stated otherwise:

Contracts are formed between Vendor and Purchaser
REALM is not the owner of listed goods
REALM is not responsible for quality, safety or fitness for purpose

Any disputes between Vendor and Purchaser must be resolved between those parties. REALM may assist but is not obligated to mediate.

8. Fees and Charges

Fees may include:

Listing fees
Commission on sale
Buyer’s premium
Marketing costs
Platform fees

Applicable fees will be disclosed prior to engagement. Additional third-party fees may apply depending on sales channels used.

9. Payments

All payments must be made within the timeframe specified, using approved methods, and inclusive of GST where applicable. Failure to pay may result in cancellation of sale and recovery action.

10. Delivery and Collection

Unless otherwise agreed, purchasers are responsible for collection, transport and insurance. Risk passes to the purchaser at the time specified in the sale terms. Storage fees may apply for late collection.

11. Misrepresentation and Rescission

If a listing is materially misrepresented, the sale may be rescinded. The Vendor may be responsible for all return costs, and purchaser losses may be recoverable. REALM reserves the right to determine appropriate remedies.

12. Intellectual Property

All content on REALM platforms is owned by REALM or its licensors and protected by law. You must not copy or reproduce content, scrape data, or use materials commercially without permission.

13. Electronic Communications

You consent to receiving communications electronically, including email, SMS, and platform notifications. Electronic communications satisfy legal requirements for written notice.

14. Privacy

Use of REALM services is also governed by our Privacy Policy.

15. Limitation of Liability

To the maximum extent permitted by law, REALM is not liable for loss of profit, business opportunity, indirect or consequential loss, errors or interruptions in service, or acts or omissions of Vendors or Purchasers. Nothing in these Terms excludes rights under the Australian Consumer Law.

16. Indemnity

You agree to indemnify REALM against losses arising from breach of these Terms, misuse of the platform, inaccurate listings, or unlawful activity.

17. Suspension or Termination

REALM may suspend or terminate access at any time if Terms are breached, fraud or misuse is suspected, or required by law.

18. Force Majeure

REALM is not liable for failure to perform due to events beyond reasonable control, including natural disasters, system failures, government actions, or industrial disputes.
